As most of you know, fiduciaries have significant obligations with respect to retirement benefit plans that are subject to ERISA. However, do you know you may also have fiduciary obligations with respect to group health plans that are subject to ERISA? With the increase in transparency requirements applicable to group health plans under the Consolidated Appropriations Act, 2021, we expect to see more class action breach of fiduciary lawsuits filed by plaintiff attorneys against group health plans and their fiduciaries (similar to what has been occurring with respect to retirement plans for the past 10-15 years).
